If you are an investor from a qualifying “treaty country” then an E-2 visa may allow you to live in the United States for the purpose of owning and running a qualifying business or enterprise.

Qualifying criteria :

1. Be a national of a country with which the United States maintains a treaty of commerce and navigation
2. Have invested, or be actively in the process of investing, a substantial amount of capital in a bona fide enterprise in the United States
3. Be seeking to enter the United States solely to develop and direct the investment enterprise. This is established by showing at least 50% ownership of the enterprise or possession of operational control through a managerial position or other corporate device.

Notes :

The E2 visa is generally available for upto 5 years and can be extended indefinitely as long as the business and its ownership are maintained
“Substantial Investment” means substantial in relationship to the total cost of either purchasing or establishing a new one.
The investment must be sufficient to ensure the investor’s financial commitment to the successful operation of the enterprise
Spouse and children under the age of 21 can be included on the application
The application may be filed at a U.S. Consulate abroad, or by filing a petition with US Citizenship and Immigration Services (USCIS) to change status if you are already in the U.S.
